Summary

In October 2023 a majority of the Supreme Court of Canada found that the main impact assessment scheme of the federal Impact Assessment Act was unconstitutional. 

West Coast Environmental Law Association and other legal and impact assessment experts believe that the Act can be amended to preserve a strong federal impact assessment regime while respecting the constitutional division of powers, and sent this letter to the Prime Minister recommending how to do so.
